Terms of the private beta
PathKit is in private beta. These terms cover using it while it is.
Who you are agreeing with
PathKit is run by Boardly Systems OÜ. The full details are in the imprint. By creating an account or using PathKit you agree to these terms.
A beta, provided as it is
PathKit is unfinished and we are still changing it. It is provided as it is, without any promise that it is available at a given time, free of faults, or fit for a particular purpose. There is no service level. Features can change, move to a paid plan, or be removed.
Your data
What you put into PathKit stays yours. You give us the right to store, process and display it only as far as running the service for you and the people you share it with requires. How we handle personal data is in the privacy policy.
While PathKit is in beta we may need to reset data, for example when the way boards are stored changes. We will tell you by email at least 14 days before, so you have time to export what you need. Keep your own copy of anything you cannot afford to lose.
What you may not do
Upload anything you do not have the right to use, try to reach workspaces that are not yours, get around the limits of your plan, or put a load on the service that stops it working for anybody else.
Feedback
If you send us feedback, ideas or bug reports, we may use them to improve PathKit without owing you anything for it. We never publish your boards or name you without asking.
Ending it
You can stop using PathKit and ask us to delete your account at any time, by writing to hello@pathkit.ai. We can end your access with 14 days notice by email, or at once if you break these terms in a way that harms the service or other people. The beta itself can end, and if it does we will tell you at least 30 days before and give you a way to export your boards.
Liability
The beta is free. We are liable without limit for intent and gross negligence, for injury to life, body or health, and under product liability law. For ordinary negligence we are liable only for breach of an obligation that is essential to the service, and then only for the damage that was typical and foreseeable. Otherwise we are not liable.
Changes to these terms
We will tell you by email before a change takes effect. If you do not agree, you can stop using PathKit before it does.
Governing law
Estonian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you use PathKit as a consumer, this does not take away the protection of the law of the country you live in.
